Codes of practice

Section 87 of the Leasehold Reform, Housing and Urban Development Act 1993 makes provision for approved codes of practice that are "designed to promote desirable practices in relation to .. the management or residential property". The section provides that failure to comply with any provisions of an approved code of practice does not of itself render any person liable to any proceedings, but in any proceedings, the code of practice shall be admissible as evidence and "any provision of any such code which appears to the court or tribunal to be relevant to any question arising in the proceedings shall be taken into account in determining that question" (s87(7)(b)).

Approval of Codes of Management Practice (Residential Property) (England) Order 2004 (SI 2004/1802)

This order approves a code of practice made under s87 called the Rent Only Residential Management Code, published by the Royal Institution of Chartered Surveyors(ISBN 184219 070 9).

The Approval of Codes of Management Practice (Residential Property) (Wales) Order 2006 (SI 2006/178 (W.29)).


This is the Welsh order approving a code of practice relating to the management of residential property by landlords and others who discharge the management function. The approved code is the Rent Only Residential Management Code published by the RCS Business Service Ltd (ISBN 184219 2094).


Approval of Code of Management Practice (Private Retirement Housing) (England) Order 2005 (SI No 3307)

This Order approves a code of practice relating to the management of private retirement housing by landlords and others who discharge the management function. The approved code is The Code of Practice for Private Retirement Housing (ISBN 0-9526691-2-9) published by Chain and Pyle, Unit 3, King James Court, King James Street, London, SE1 0DH.
