The changes to Part II of the Landlord and Tenant Act 1954 came into effect on 1 June 2004. They were brought about by The Regulatory Reform (Business Tenancies) (England and Wales) Order 2003 (SI No. 3096).
The impact of these reforms has been reviewed by the Government and recommendations for further change, to improve the system further, were published by the Government in October 2006. A summary of the recommendations is set out at the end of this page.
Summary of changes made in 2004
Contracting out and surrenders
- Normally L required to give T at least 14 days notice before entry into tenancy of the proposal to exclude security. Notice to contain prominent health warning. T to sign a "simple declaration" that he has received it.
- In urgent cases it is possible to waive the 14-day requirement but T is required to sign a statutory declaration that he has received the notice, read it and accepted its consequences.
- Similar provisions in relation to agreements to surrender.
Ownership and control
- Various changes that have the effect of treating an individual and any company he controls as equivalent. Applies to L or T.
